These General Terms and Conditions of Sale define the rights and obligations of the parties in the context of the sale of genealogical research services by Daniel Derveaux.
Nature of services
The services offered consist of personalised genealogical research based on archives. Any order implies acceptance of these GTC.
Order
All research requests must be made using the contact methods indicated on the site. After analysing the request, an estimate will be drawn up and sent to the customer. The order will be considered validated once the quotation has been accepted and full payment has been received.
Rates and payment
The prices of the services are indicated in euros (€) and are mentioned on the site or in the quotation sent to the customer. Payment of the 25% deposit is required when the order is confirmed. The full balance must be paid before delivery of the results. Payment can be made by bank transfer or by any other means indicated when the order is placed.
Cancellation policy: In the event of cancellation of the order by the customer, the deposit paid will be retained by the publisher. This deposit is intended to cover the costs incurred in preparing the research. No refund of the deposit will be made in this case.
Completion times
Lead times vary according to the complexity of the research and the volume of work in progress. An estimated deadline will be communicated to the customer before the order is validated. However, this timeframe is indicative and does not constitute a firm commitment.
No right of withdrawal
In accordance with Belgian legislation and the provisions of the RGPD, as the services offered are tailor-made at the customer's request, no reimbursement will be made once the order has been validated.
Refusal to order
The publisher reserves the right to refuse any order that does not fall within its field of expertise. In this case, no invoicing will be applied.
Liability
The genealogist undertakes to provide rigorous and documented work, but cannot guarantee the exhaustiveness of the results or the systematic discovery of the information sought.
Confidentiality
The information provided by the customer is strictly confidential. Research results may be made public only if the individuals concerned were born at least 100 years ago and are deceased. In all other cases, no information will be communicated to third parties without the customer's consent.
Intellectual property
The results of genealogical research are intended for strictly private use. Any commercial use of the research results is prohibited without the prior written consent of Daniel Derveaux. The information and documents provided to the client remain the intellectual property of Daniel Derveaux, unless otherwise stated.
Mediation of disputes
In the event of a dispute, the customer may have recourse, free of charge, to a consumer mediator before taking any legal action, in accordance with the articles of the Consumer Code. The contact details of the competent mediator will be communicated on request.
Applicable law and jurisdiction
These General Terms and Conditions of Sale are governed by Belgian law. In the event of a dispute, the parties shall endeavour to find an amicable solution before initiating any legal proceedings. In the absence of an amicable agreement, any dispute will be referred to the competent Belgian courts.
